Daily Duties at Rlg, Lawyers Mediators, Pllc:
Provide general counsel services, including counseling, guidance, and training to legal departments, stakeholders, HR, and C-Suite, regarding all aspects of labor and employee relations, global labor & employment, and immigration laws, and/or regulations, EEO, AA, OFCCP, global mobility, privacy, cybersecurity, anti-corruption, fraud, healthcare, corporate and ethics compliance, risk management assessments and options to avoid and/or mitigate potential losses and litigation, M&A, reorganizations, and change management, as well as administer ERISA benefit plans, short—long term medical and comp leave, accommodations, and strategic development of policies, practices, procedures and best practices • Mediator in employment, commercial, and personal injury disputes, and labor arbitrator presiding over CBA negotiation disputes, interpretations, union grievances of policies, corrective actions, and drafting opinions adjudicating the same • Handle global employer and business visas for investors, employees, expats, and their families—E, F, G, H, I, J, K, L, O, P, TN—conduct compliance audits, defend and adjudicate labor arbitration, proceedings, union campaigns, and draft structure. Negotiate, administer, and litigate a variety of contracts and agreements, including, buy-sell, formation, shareholder, directors, executive compensation, severance, collective bargaining, employment, independent contractor, consulting, temporary, management, IP, invention, exclusivity, confidentiality, indemnity, arbitration, release of liability, waiver, manufacturing, distribution, retail sales, transportation, logistics, goods and services, construction, benefits, non-disclosure, restrictive covenant, vendor, supply, etc. • Counsel, advise, and train HR and stakeholders regarding employee classification, wage and hour, equal pay, recruitment, onboarding, hiring, retention, leave—FMLA, PTO, ADA—OSHA, safety, H&S programs, executive-employee compensation, disciplines, separation, unemployment, severance, global privacy, accommodations, harassment, social media, diversity, tax withholding, garnishments, and worker’s compensation • Conduct internal EEO, retaliation, disparate treatment—impact, NLRB, FLSA, fraud, theft, conduct, FTC, Antitrust, AML, BSA, privacy, cybersecurity, immigration, harassment, DOL, OSHA, DHS, ICE, FINRA, DFEH, and DSLE investigations and audits, including, intake, investigative interviews, analysis, conclusions and recommendations; defend single, multi, collective, and class action, PI, commercial, products, and contracts, Title VII, ADA, ADEA, FLSA, FMLA, OSHA, ERISA, EPA, PDA, retaliation, §1981-83 actions, whistleblower, Qui Tam, SOX, non-competes, trade secrets—marks, non-solicitation—disclosures, FEHA, PAGA, TCHRA, and related tort and state law employment-related litigation • Prepare decision-tree analysis, litigation forecasting, and budgeting from inception through appeal, and formerly managed fully staffed multi-state business defense law firm, including, daily operations, business development, staff and attorney recruitment, hiring, discipline, training, forecasting and budgeting firm operations, client billings, payroll, and expenses
