Member Oregon State Bar
• Work with stakeholders including Governor’s staff, Agency Administrators and Directors, Legislators and insurance company executives to negotiate legislation, administrative rules, and advisory bulletins using alternative dispute resolution including mediation and negotiation. Track legislative bills, perform bill analysis, work with legislative committee staff and legislative counsel to draft bill amendments, testify before legislative committees to present Department position on Bill, and provide information to Legislators on Agency mission and impact of legislation.
• Monitor Oregon insurance companies’ compliance with state and federal laws and the Oregon Insurance Code (including legal, financial, and ethical issues). Ensure compliance with state federal statutes including: the Employee Retirement Income Security Act (ERISA), Title VII of the Civil Rights Act of 1964 (Title VII), the Equal Pay Act of 1963 (EPA),Title I and Title V of the Americans with Disabilities Act of 1990 (ADA), the Civil Rights Act of 1991, the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Federal Indian Law, the Sarbanes-Oxley Act of 2002, and federal antitrust law.
• Represent the State of Oregon Insurance Division in actions with other state and federal agencies, Indian tribes and private industry including U.S. Department of Labor; U.S. Treasury Department/IRS and Oregon Employment Department; FCC/FTC; Oregon Department of Human Services and the Centers for Medicare and Medicaid Services; Bureau of Indian Affairs, Grand Ronde and Siletz Indian Tribes, and foreign and domestic insurance companies.
• State of Oregon’s liaison to National Association of Insurance Commissioners (NAIC) and NAIC State Insurance Departments Attorney Task Force. Participate on NAIC task forces to draft model laws for state insurance departments including broker disclosure, HIPAA compliance, interstate compact, unauthorized entities and unlawful activities, antitrust and antifraud issues, and uniformity. Staff to Chair of the NAIC Health Insurance and Managed Care (B) Committee and State Innovations Task Force working on national solutions for availability and affordability of health insurance.
• Legal work includes researching, preparing legal memorandum, and ensuring compliance state and federal criminal, environmental, corporate and business, anti-trust, and employment laws and ensuring that Oregon companies and corporations comply with state and federal laws and regulations, and evaluating anti-trust issues between Oregon Hospitals and Oregon Insurance Companies.
• Develop long-term planning goals for health insurance and health policy for the State of Oregon. Organize & facilitate weekly Senior Policy/Management meeting, monthly Health Policy Team, and monthly intra-departmental meetings of consumer advocates and health analysts. Assign and review work of department staff including two direct reports.
