Daily Duties at Boston Scientific Corporation:

In this position, I was responsible for all of the personal injury litigation and government investigations for the Cardiac Rhythm Management (CRM) business unit. The CRM business unit accounts for over $2 billion in revenue annually and is the second largest business unit of BSC. In this role, I managed a mass tort litigation involving over 10,000 claimants. I also managed several government investigations involving the Department of Justice and several state Attorneys General. When I first started, I had one in-house paralegal who reported to me and three contract workers who worked for me. Over time, I hired a discovery lawyer and two additional paralegals to work for me. I also built the discovery and e-discovery capabilities for the company from the ground floor. I was specifically hired for my ability to handle high-stakes litigation after the New York Times printed several negative news stories about the CRM business unit. I was hired to manage the thousands of lawsuits and the growing number of government investigations. I was also hired to help revamp corporate practices to avoid the type of incidents which lead to the intensely negative publicity. When I was first hired, I had no experience handling white collar criminal investigations; securities lawsuits or insurance coverage matters. Nonetheless, I inherited numerous securities cases, insurance coverage lawsuits and government investigations. To manage these matters successfully, I had to learn on the job. This required doing my own legal research to learn those specific areas of the law. I was a quick learner and successfully managed the securities litigation so that I am undefeated in securities lawsuits. I also learned how to handle government investigations properly. I also learned how to handle insurance coverage matters and was able to recover over $1 million from insurance companies before the Illinois Supreme Court ruled that we would not be entitled to any futher recoveries. In addition to my litigation and investigation responsibilities, I was the main business unit support lawyer for the CRM quality system, the patient safety group, the regulatory department, the warranty group, the sales force and the marketing department. In this capacity, I initiated several projects to standardize process, procedures, official labeling and warranty language. I also supported the CRM group when being audited by the FDA or other regulatory bodies. I also provided guidance to the Finance Department on an as needed basis. Additionally, I was the main CRM lawyer responsible for providing due diligence responses in a $26 billion corporate transaction even though I had never previously handled due diligence. Again, I had to learn on the job. The transaction closed just over five months after I started providing the due diligence responses right before the holidays in 2005. In this position, I developed the e-discovery policies and procedures which later became the best practices for BSC. I directly hired outside counsel to assist with the mass tort litigation and hired firms in over 30 states. I also forced several firms to adopt fixed fees and there by reduced spend on outside law firms by millions of dollars. Additionally, I restructured how BSC handled external discovery vendors and document/data review vendors. Through these efforts, I cut discovery expenses by over $20 million. Due to my successs in reducing dsicovery expenses I won two gold and two platinum corporate VIP awards (makeing the Legal Department the only "administrative" function to win back-to-back awards). I was also responsible for developing presentations to business unit management on risk mitigation and management, risk avoidance, litigation updates and expenditures. I also helped draft external corporate communications including press releases and announcements. I won an award for my role in assisting with a physician advisory communication, and I was an integral member of the crisis management team for the business unit. I also assisted our Government Affairs group in developing responses to legislative initiatives as well as prepared responses to Congressional inquiries. I met with some Congressmen to discuss topics of interest to medical device manufacturers, and I worked directly with AdvaMed to develop responses to certain legislative initiatives.
