Daily Duties at Allied Nationwide Insurance:
Managed inventory of 100+ litigation files. Day to day responsibilities included the following. Recieved new assignments on daily basis. Determined whether there was a Duty to Defend insured against lawsuit (Coverage Analysis). This involved reviewing the pleadings (lawsuit); interviewing the insureds and other pertinent parties or witnesses for facts and extrinsic evidence; reviewing the policy contract for insuring agreement, exclusions and conditions. Researching pertinant insurance coverage cases and/or securing coverage opinions from company and outside counsel. Preparing coverage recommendations in written format and verbally for Claim Committee decision (comprised of Regional Claim Directors). This included cases where coverage is declined (no coverage) or provided under a Reservation of Rights (partial coverage). Then prepared detailed written explanation of coverage to the insured based upon decision and authority of Claim Committee. Once coverage issues were resolved, would then refer case to defense counsel to represent the insured in the lawsuit. The majority of my inventory contained claims that had been handled and failed to resolve prior to the injured party filing the lawsuit. I would conduct a comprehensive review of the facts, investigation, photos, correspondence, injury and/or property damage, medical records and reports and negotiation efforts (demands and offers). I then prepared a written report for defense counsel containing the file contents. The report would contain my analysis of the potential for defending and/or settlement of the case as well as an outline for further investigation and defense suggestions. I would give authority for any Motions to benefit the defense. Once the file was transferred to defense counsel, I would Monitor the case. This included conferencing with defense counsel to discuss the status and progress of the case. Defense counsel would provide their opinion as to the legal issues involved and progress of the litigation. I would give proper authority to retain any experts necessary for the case such as accident reconstuctions, engineers, doctors (for independent examinations). Defense counsel would prepare a budget and I would audit the budget throughout the case to ensure the expenditures and fees were reasonable and necessary. During the course of litigation I would review all information secured in litigation such as deposition testimony, expert reports, additional medical reports and evidence. I would Evaluate the settlement potential of the case and secure any settlement authority above my own. Since I handled the large and complex litigation, it was common to prepare detailed and technical reports requesting settlement authority at the Regional level. I would also adjust the claim file reserves as required by State regulations as file developed. As each case progressed I was responsible for audit and payment of all attorney, expert and vendor bills. I required little to no Management supervision. My files were reviewed by management online and my recommendations routinely authorized without any changes. Determined potential for settlement of cases and would negotiate directly with plaintiff counsel as required by the Company. If case reached settlement, would then instruct defense counsel to prepare settlement agreements and dismissals and I would issue settlement draft to exchange once plaintiff executed the release and dismissals. I would notify the insured of the settlement and dismissal of the lawsuit. If the case failed to reach settlement, then court may require a Mandatory Settlement Conference. I would appear before the case assigned Judge with defense and plaintiff counsels. I would argue the defenses case with defense counsel and adjust my evaluation based upon any new evidence and opinion of the presiding judge as to merits of case. If negotiations were still viable, but failed to settle at Mandatory Conference, I would consider whether binding or non-binding Arbitration would benefit the chances of settlement. In these cases, I would again appear at the Arbitration with settlement authority in sessions that sometimes took place over the course of a day or multiple day sessions. In cases that failed to settle prior to the court setting a Trial date, I would prepare an extensive and detailed report for review by management. I would monitor the Trial activity on a daily basis. This would include attending the most pertinent testimony, daily conferencing with counsel, verbal status with insureds, and analysis of outcome of trial. Was verdict within my settlement evaluation? What was meritous and/or detrimental in Trial? Effectiveness of defense counsel. I would prepare a Post Trial Report for management which would explain the resolution of the case at Trial and I would prepare any draft as outlined in the verdict (if not a full defense verdict). In very few cases, the verdict would indicate that an Appeal is necessary. I would secure defense counsel's opinion and conference with management and Appeallate counsel as to the merit of appealing a judgement. If Regional mgmt agreed, would prepare the file for Appeallate counsel and start the process rolling. I maintained ownership of the file and montioring progress at Appellate level. In addition to the above Litigation Management, I had additional duties. I would Mentor and train less experienced claim reps. I would assist others in evaluating settlements through Round Table sessions. I would speak at Company presentations to new staff on the Litigation Process. I faciltated fundraising for many Company charities such as the United Way and Juvinal Diabetes foundation.
