Daily Duties at Liebmann, Conway, Olejniczak & Jerry, S.C.:

Throughout my five year tenure as an attorney at Liebmann, Conway, Olejniczak & Jerry, S.C. ("LCOJ"), I worked almost exclusively within the litigation department, focusing my practice on municipal, administrative, insurance, and personal injury areas of law. Although the atmosphere at LCOJ was that of an “open door” policy, the case load of most attorneys therein, especially litigation attorneys, was heavy. As such, my supervision was limited, resulting in a case load for which I began independently handling shortly thereafter to such a degree that I was “first chairing” civil and administrative trials within my first year of employment from their date of commencement all the way to a verdict/decision, if necessary. With specific regard to my municipal experience, I represented, among other entities, the Village of Bellevue, prosecuting civil ordinance violations, defending civilian claims, and counseling the Village Board on administrative/legislative issues. Illustrative of the latter, I assisted the Village Board in its enactment of an ordinance that placed a blanket ban on billboards, ensuring, specifically, that said enactment was not only constitutional, but consistent with the statutory mandates of Wisconsin’s 2010 Smart Growth plan. I also served as corporation counsel for the Village of Bear Creek and was retained as defense counsel by the counties of Door and Oconto, which, in addition to the litigation associated therewith, required my advice on numerous issues such as the manner in which to respond to any notices of claims, whether to enter into settlement negotiations, and the most effective, as well as efficient, strategies in which to litigate cases in general. In addition to the aforementioned entities, I represented numerous civilians in regards to municipal issues, counseling them on, among other topics, the reasonableness of building permit denials, the legality of condemnation/raze orders, and the constitutionality of an ordinance that deemed my client’s dog dangerous, as well as the sufficiency of the procedural due process associated therewith. With regard to my “non-municipal” experience as a trial attorney, within one month of employment at LCOJ, I second chaired a jury trial in Door County, Wisconsin, representing a couple in regards to a just compensation dispute following the partial condemnation of their business property. Shortly thereafter, I first chaired a bench trial, successfully defending the County of Oconto against an adverse possession claim and second chaired a negligence claim, obtaining a jury verdict in favor of my client for damages he suffered during an auto accident in Shawano County. On numerous occasions, I was able to reach a favorable result for my client short of trial. For example, I succeeded in receiving a court dismissal of my client from a negligence claim by arguing in support thereof that the alleged negligent party was an independent contractor, as opposed to an employee of my client, thereby eliminating my client from liability under the law at issue; a court reversal of the Department of Health and Family Services’ decision to deny medical assistance to my client; and a court decision, following the filing of a Motion to Intervene, Bifurcate, and Stay, that the policy at issue covered one, if not more, of the claims filed against my client, the insured, thereby granting him the defense/indemnification afforded therein. Along with the day to day counseling related to my litigation files, I accepted several invitations to act as guest speaker at various seminars, which included a 2009 corporation counsel seminar in Door County, Wisconsin, whereby I advised attorneys, as well as administrative staff, on the pending application of Wisconsin’s 2010 Smart Growth Plan; a private seminar at Schreiber Foods in Green Bay, Wisconsin, whereby I advised employees on the manner in which to conduct commercial sales under the Uniform Commercial Code; and the 2009 Annual State Bar Convention, whereby I spoke on the issue of insurance subrogation under ERISA plans, making me the Convention’s youngest guest speaker as of date. .
